These Terms of Service ("Terms") govern your use of the Check Engine Insights mobile application ("App") operated by HCAC Ventures, LLC ("Company," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Check Engine Insights is a vehicle diagnostic application that connects to OBD-II adapters to read vehicle data, diagnostic trouble codes, and provide AI-powered diagnostic reports. The App is intended for informational purposes only.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

4. Subscriptions and Payments

Certain features require a paid subscription or one-time purchase. By subscribing or purchasing:

  • You authorize us to charge your payment method for the applicable fees
  • Subscription fees are billed in advance on a recurring basis (monthly or annually)
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • Refunds are handled in accordance with our refund policy

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to collect data about other users
  • Resell or redistribute the App or its content

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

IMPORTANT: The diagnostic information provided by the App is for informational purposes only and should not be relied upon as professional automotive advice. We strongly recommend:

  • Consulting a qualified mechanic before making any repairs based on diagnostic information
  • Not relying solely on the App to determine vehicle safety or roadworthiness
  • Understanding that AI-generated reports are suggestions and may not cover all possible causes or solutions

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HCAC VENTURES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Vehicle damage or mechanical failures
  • Personal injury or property damage
  • Loss of data or profits
  • Business interruption

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless HCAC Ventures, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

9. Intellectual Property

The App and its content, features, and functionality are owned by HCAC Ventures, LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Third-Party Services

The App may integrate with third-party services (e.g., NHTSA for recall data, Stripe for payments). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party content or services.

11. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
